Designs must have a clean and colored reference. We will not accept written or uncolored references. Any unfinished references that require editing will incur a fee (i.e. filling in color, adding accessories, etc).

Exploiting loopholes within these terms of service is considered a malicious act and will result in the immediate cancellation of any and all services. Clients participating in this behavior will be blacklisted from any future work.

DoubuTroubu is an ever-growing and developing brand that may be subject to change at the discretion of the artist(s) involved. By commissioning us, you agree to these terms.

All Intellectual Property Rights over and with respect to the commissioned work are owned by DoubuTroubu. The client does not acquire any rights of ownership to the commissioned work.

By agreeing to these terms of service you agree that, in the condition that these terms are violated, DoubuToubu maintains the right to resell and modify their work, including that of designs, concepts, and intellectual property belonging to the client, to increase marketability.

We do not accept commissions that depict copyrighted material not belonging to the client.

Chargebacks: Chargebacks, in the context of these terms of service, are claims made by a client to a credit card provider or banking service demanding a retailer or business to make good the loss on a fraudulent or disputed transaction.

Defamation: Defamation, in the context of these terms of service, refers to any actions, taken by the client, that damage the reputation of the brand.

Indemnification: Indemnification, in the context of these terms of service, refers to security against legal liability.

Intellectual Property: Intellectual Property (IP) refers to any intangible product of original human creation including, but not limited to, inventions; literary and artistic works; and designs.

Marketability: Marketability, in the context of these terms of service, refers to the quality that any former commission may have of being attractive to customers and easy to sell thereafter.

Queue: Queue refers to the current list of clients with commissions being actively completed.

WIP: WIP stands for work in progress.

To the extent permitted by law, DoubuTroubu will in no way be liable to the client or any third party for any loss or damage, however caused (including through negligence), which may be directly or indirectly suffered in connection with any use of the commissioned work.

The client is provided by DoubuTroubu on an “as is” basis.

DoubuTroubu will not be held liable by the client in any way, for any loss, damage or injury suffered by DoubuTroubu or by any other person related to any use of the commissioned work or any part thereof.

Notwithstanding anything contained in these terms of service, in no event shall DoubuTroubu be liable for any claims, damages, or loss which may arise from the modification, combination, operation, or use of the commissioned work with client’s computer programs.

DoubuTroubu does not guarantee that the commissioned work will function in any environment.

All payments will be conducted through an invoicing service, preferably PayPal. All prices listed are in USD.

Clients will receive an itemized invoice depending on the agreed payment method.

Individuals using any payment or banking service to purchase items within our community are assumed to be 18 years of age or older, and the owner of the payment or banking service account.

Clients may choose to pay in full or with a payment plan if the overall price of the commission exceeds $300 USD or more. Services do not begin until payment has been received as discussed.

Clients who opt to pay via payment plan will not receive the unwatermarked, full resolution files until the remaining payment is received.

Regarding payment arrangements, the client agrees to make installment payments that correspond with each completed phase of the process for their respective project commencing with a non-refundable down payment of 25% of the total project cost.

We maintain the right to a resale of our work under certain conditions. This includes the right to modify any work done by DoubuTroubu, including that of designs not created by DoubuTroubu, to increase marketability. Applicable conditions include:

Chargebacks or cancellations of services in violation of these terms of service.

Public defamation that may damage DoubuTroubu's reputation.

A transferral or resale of licensing of any and all corresponding asset(s) without DoubuTroubu's express permission.

If the client uses any asset, design or illustration, for commercial purposes outside of their license agreement without DoubuTroubu's express permission.

The use of any asset, design or illustration, in blockchain-related or computer-generated image technology.

Clients who participate in chargebacks or other malicious behavior will be blacklisted from any and all future services. Associated accounts may be reported if necessary.

Correspondence refers to direct communication between DoubuTroubu and the client using a messaging system (i.e. Twitter’s direct messaging system, Discord).

Clients are required to communicate and provide us with feedback so that we may produce the best possible product.

Should the client fail to respond within 14 days of the last correspondence, the project may be subject to cancellation. Upon cancellation, the client may receive non-editable, full-resolution .PNG files of any art commissioned depending on the level of completion of the project, unless the client has broken the terms of service written in this document. Images with transparent backgrounds will not be given to the client.

If commissioning a custom design, at any time during the sketch phase, the client is entitled to three free major revisions, as determined by DoubuTroubu. After three major edits, or if extensive minor edits have been made, future revisions will incur a fee.

Revisions requested after the sketch phase (i.e. during lining, color, etc.) will incur a fee. The complexity of the edit requested will determine the price of the revision.

Clients are expected to credit us as DoubuTroubu in their social media biographies/descriptions and posts regardless of whether one or both person(s) worked on the commission.

In the case that the client wishes to post a commission or commission WIP, DoubuTroubu should be tagged in the main tweet at the time of posting. Repeated failure to credit, using a slash to avoid tagging, or crediting separately from the initial post, may result in the client being blacklisted from future work.

The client cannot use the commission for any purposes other than those specified in this agreement.

The client may permit its employees to use the commission for the purposes described in this agreement, provided that the client takes all necessary steps and imposes the required conditions to ensure that all employees using the commission do not commercialize or disclose the contents of it to any third person, or use it other than in accordance with the terms of this agreement.

No changes to the commission or its contents may be made by the client.

The client will not distribute, sell, license or sub-license, let, trade or expose for sale the commissioned work to a third party.

No copies of the commission are to be made other than as expressly approved by DoubuTroubu.

The client will provide technical and security measures to ensure that the commission, which the client is responsible for, is physically and electronically secure from unauthorized use or access.

The client shall ensure that the commissioned work retains all of DoubuTroubu’s copyright notices and other proprietary legends and all trademarks or service marks of DoubuTroubu.

The use of any and all of our works in blockchain-related technology, such as NFTs and/or any form of cryptocurrency, or artificial learning programs, such as those used to create computer-generated works, is strictly prohibited.

With the completion of the final payment, DoubuTroubu grants the client a non-exclusive, non-transferable license to use the commission according to the mutually agreed upon terms specified in these terms of service. This transfer of rights permits client to utilize the final product for the following:

Use for advertisements on social media. This includes, but is not limited to, the creation of digital, influencer-created content and stream-related graphics (i.e. schedules, calendars, screens and overlays), and stream captures.

Use for live streaming purposes on any streaming platform in accordance with these terms of service.

If our services were responsible for the illustration/design of the model, the client may NOT use the illustration nor the design for merchandise. An additional premium commercial-use fee may be negotiated in order to obtain this right.

Clients belonging to a corporation or those with a large digital presence will pay higher commercial fees which give them the right to use the work in corporate streams, sponsored streams, events, etc. depending on negotiated terms. This fee is associated with the total project cost and is proportional to the estimated popularity of the client or organization.

Clients belonging to a corporation or those with a large digital presence should expect a maximum estimated total cost of around 300% of the base price.

Clients belonging to a corporation or those with a large digital presence will automatically receive priority over those in the normal queue. This does not include potential rush fees.

Clients belonging to a corporation or those with a large digital presence are entitled to a default confidentiality agreement, distinct from regular customers.

An extended license grants the client the right to use the commissioned work for commercial means including, but not limited to, the sale of physical and/or digital goods and products, paid ads, email marketing graphics, and industry events (i.e. conventions, award ceremonies, etc.).

Clients should expect a maximum estimated total cost of around 200% of the standard license grant.

DoubuTroubu acknowledges that any personal or business information provided by the client is confidential and must be protected from unauthorized disclosure. Both parties agree to safeguard and preserve the disclosing party's Confidential Information, which will only be recorded for legal and archiving purposes.

DoubuTroubu reserves the right to utilize the outcomes of the project, including artwork, designs, animations, written content, and any other creative assets, for the purpose of portfolio development and promotional activities. This right extends to showcasing the work in various platforms, including DoubuTroubu’s official website, social media channels, design portfolios, award submissions, and industry events.

If DoubuTroubu is asked to keep a project non-disclosed until a certain date, the client agrees to pay a confidentiality fee of 10% of the total project to compensate for the loss of marketing opportunities and potential customers that could have been gained during that marketing period.

Clients should discuss and reach a mutual agreement on the terms of any non-disclosure agreements in place prior to payment. Failure to make a request by the client may result in DoubuTroubu disregarding the agreement.

Upon the client's public release of the delivered assets, the confidentiality period will conclude. Consequently, DoubuTroubu gains the freedom to promote the work without any restriction from the client.

Full refunds will NOT be issued for commissions that have already been started. In the event that the client wishes to cancel the project after the commission has begun work, but before completion, the client agrees to pay a cancellation or kill fee to compensate for the time and resources already invested in the project.

The client is responsible for any and all transactional fees associated with the use of an online banking service.

A partial refund may be discussed for the work not yet completed. All cancellation fees will be in accordance to the percentage of work completed. If the project is 75% or more complete, the client agrees to pay the full project fee as originally agreed upon in the agreement and complete the commission as originally requested.

The client will be provided with an itemized invoice indicating the work completed to date and the corresponding amount due at the time of cancellation. Payment of the cancellation fee is due within 14 days of invoice receipt. If the cancellation fee is not received the client will be blacklisted from any future projects.

Upon cancellation, the client may receive non-editable, full-resolution .PNG files of any art commissioned depending on the level of completion of the project, unless the client has broken the terms of service written in this document. Images with transparent backgrounds will not be given to the client.

Clients will not receive any unfinished .CMO3 files for use in any face tracking software.

In the event that DoubuTroubu fails to correspond with the client within 3 months following the specified start date, the client may request a refund.

A partial refund may be issued if at any point the client’s commission is unable to be completed. In the unlikely case we are unable to fulfill a commission, we will contact the client for refund details.

Refund terms can be negotiated if DoubuTroubu has exceeded the set and agreed upon deadline.

Expected wait time is between 4 weeks to 6 months after payment has been received. However, the estimated delivery date may be extended for the following reasons:

The type of commission requested. The more complicated the commission type, the longer it will take to finish.

The mutually agreed-upon duration for making payments.

Delays in correspondence from the client.

Circumstances which result in one or more of the phases of the project taking longer than initially expected. This may be due to client requested revisions or communication errors.

Delivery time for commissions will vary based on queue length.

Clients with time-sensitive projects may incur a rush fee of up to 50% of the total commission cost. The rush fee is determined by the complexity and turnaround time required for the project. To facilitate timely completion, clients must inform DoubuTroubu of any deadlines at the initial contact stage. If clients neglect to notify DoubuTroubu of deadlines before making payment, they must adhere to the standard wait time.

Clients DO NOT receive any editable commission files, only those files which have been prepared for the face tracking program (VTube Studio). Original commission files may be requested at an additional cost.

Clients have up to 7 days to save their delivered assets once completed.

The client shall defend, indemnify and hold harmless DoubuTroubu and its employees, agents and subcontractors from all liabilities, claims and expenses, including all reasonable legal fees that may arise or result from any service provided or performed or agreed to be performed or any product sold by the client, its agents, employees or assigns; any injury to person or property caused by any products or services sold or otherwise distributed in connection with DoubuTroubu; the client's use of electronic commerce; and any defective product which the client has provided via the services.

This clause will survive termination of any agreement.

We will begin with sketching the character into the scene and plotting colors. The client may ask for edits at this point.

After approval, we will move onto asset designs and rough animation. We will give an update upon completion.

After the update, we will move onto background and cleaning the animation. We will give an update upon completion. The client MAY NOT ask for a refund at this point.

We will finalize the animation and add the required effects.
